This can encompass details such as your name, email address, phone number, payment information (for Users with Paid Services), content included in your communications with us and fellow platform users, as well as Personal Information found in scanned identification documents (e.g., ID cards, driver's licenses, passports, or official company registration documents).

  2. Information Collected During Service Usage: As you engage with our Services by visiting, downloading, and/or using them, we may gather aggregated usage-related Personal Information. This can encompass data related to Visitors' and Users' browsing activity, 'click-stream' behavior on the Services, session heatmaps, scrolling patterns, and non-identifying information about the Visitor's or User's device.   • When necessary to fulfill a contract or take steps leading to a contract with you (e.g., providing website builder services, customer assistance, and technical support).

  • When necessary to comply with relevant legal or regulatory obligations.

  • When supporting legitimate interests and business purposes, such as maintaining and enhancing our Services and the effectiveness of ClickMeMe by identifying technical issues. We ensure that such usage is proportionate and respects your privacy rights.

4. How we share your ‘Personal Information’

We may disclose your Personal Information to service providers and other entities (or grant them access to it) in the following ways and situations:

4.1 Third-Party Service Providers

ClickMeMe has established partnerships with select service providers whose offerings complement, facilitate, and enhance our own services. These include providers of hosting and server co-location services, communications and content delivery networks (CDNs), data and cybersecurity services, billing and payment processing services, domain name registrars, fraud detection and prevention services, web analytics, email distribution and monitoring services, session recording and remote access services, performance measurement, data optimization, marketing services, content providers, as well as our legal and financial advisors (collectively referred to as "Third-Party Service Providers").

ClickMeMe may share the following categories of Personal Information with Third-Party Service Providers for business purposes:

  • Identifiers: This category includes information such as your name, alias, postal address, unique personal identifier, online identifier, internet protocol (IP) address, email address, account name, or similar identifying details.

  • Commercial Personal Information: This encompasses Personal Information relating to products or services you have purchased, obtained, or considered.

4.2 Law Enforcement, Legal Requests and Duties

ClickMeMe may reveal or grant access to any of the categories of your Personal Information as outlined in this Privacy Policy in response to a legal demand, which may include a subpoena, legal proceedings, search warrant, or court order. This disclosure may also occur to comply with relevant laws, should we possess a genuine belief that such compliance is legally mandated, with or without prior notice to you.

4.3 Protecting Rights and Safety

ClickMeMe may disclose any categories of your Personal Information described in this Privacy Policy if we hold a sincere belief that doing so will contribute to safeguarding the rights, property, or personal well-being of ClickMeMe, any of our Users, Users-of-Users, or any member of the general public. 4.4 In connection with a change in corporate control

Furthermore, in the event of any change in control of ClickMeMe or any of its affiliates, such as through a merger, acquisition, or the substantial purchase of its assets, your Personal Information may be shared with the entities participating in such transaction.

4.5 Upon your explicit instruction

The ClickMeMe Services offer you various methods to engage and acquire third-party services, products, and tools to enhance your web or mobile sites. These include applications and widgets provided by third parties via the ClickMeMe Website (including the ClickMeMe App Market), eCommerce payment providers, and third-party designers who may assist you with your website, among others (collectively referred to as "Third Party Services"). If you opt to utilize these Third Party Services, they may gain access to and process Personal Information from the Users-of-Users who interact with your web or mobile sites. Here are some examples:

a) Framed Pages: Our Services may enable you to integrate Third Party Services directly into your web or mobile sites using techniques like page framing to display content from or to Third Party Services or other parties. In such cases, the Third Party Services may collect Personal Information from your Users-of-Users.

b) App Market Developers: We permit third-party developers ("Third Party Developers") to create and offer their own applications via the ClickMeMe App Market ("Third Party Apps") to Users, which you can integrate into your web or mobile sites. Each Third Party Developer is bound by the ClickMeMe App Market Partner Agreement, which includes restrictions on how these developers can access, store, share, and use the Personal Information you and/or your Users-of-Users provide to them.

b) Social Media Features: Our Services may enable you to incorporate certain Social Media features, widgets, and single sign-on features like "Facebook Connect" or "Google Sign-in" ("Social Media Features") into your web or mobile sites. These Social Media Features may collect specific Personal Information from your Users-of-Users, such as identifiers (e.g., name, alias, unique personal identifier, online identifier, internet protocol address, email address, or similar identifiers). Social Media Features are hosted either by a third party or directly on our Services.

It's important to note that in the examples mentioned in this Section 4.5, ClickMeMe serves solely as an intermediary platform that allows you to procure the services of these Third Party Services (including but not limited to Third Party Developers, Third Party Apps, and Social Media Features) with which you interact directly and at your discretion. In this capacity, ClickMeMe acts as a service provider on your behalf, sharing information with the Third Party Services at your direction or with your consent. ClickMeMe is not and shall not be responsible for the processing of such Personal Information by these Third Party Services, nor shall it be liable in connection therewith.

ClickMeMe does not govern or assume responsibility for the actions or policies of any Third Party Service, and your use of any Third Party Service is undertaken at your own risk. We encourage you to review the privacy policy associated with any Third Party Service and seek clarifications from them as needed before deciding to install and/or use their services.

5. How We Use Personal Information

The information we request, collect, and process is primarily used to provide users with the product or service they have requested. More specifically, we may use your personal information for the following purposes:

  • to provide the service or product you have requested;
  • to facilitate the creation of a User Contract (see Terms of Service for more information);
  • to provide technical or other support to you;
  • to answer inquiries about our services or to respond to a complaint;
  • to promote our other programs, products, or services that may be of interest to you (unless you have opted out from such communications);
  • to allow for debugging, testing, and otherwise operating our platforms;
  • to conduct data analysis, research, and otherwise build and improve our platforms;
  • to comply with legal and regulatory obligations;
  • if otherwise permitted or required by law; or;
  • for other purposes with your consent, unless you withdraw your consent for these purposes.

The 'lawful processing' grounds on which we will use personal information about our users are (but are not limited to):

  • when a user has given consent;
  • processing is necessary for compliance with our legal obligations;
  • when necessary for the performance of a contract to which the user is a party;
  • processing is necessary in order to protect the vital interests of our users or of another natural person.
  • processing is done in pursuing our legitimate interests, where these interests do not infringe on the rights of our users.

We use automated decision-making when helping match users to jobs. The primary way this occurs is through how we rank users. These rankings are produced by analyzing user-generated content, user activity, and the outcome of jobs; in this context, user-generated content will include reviews that users receive when completing jobs. Automated decision-making is also used to recommend potential jobs to our users and as a part of our marketplace security systems.

6. Users-of-users' ‘Personal Information’

ClickMeMe may collect, store, and process certain Personal Information of Users-of-Users ("Users-of-Users Information") exclusively on behalf of and as directed by our Users. For instance, each of our Users has the ability to import their email contacts from third-party services like Gmail or manage contacts through their User Website, and these contacts are stored with ClickMeMe on the User's behalf.

In this capacity, ClickMe acts as a "Processor" and not as the "Controller" (as defined in the European Union General Data Protection Regulation or "GDPR") of such Users-of-Users Information.

The Users who control and operate these User Websites are considered the "Controllers" of the Users-of-Users Information and are responsible for adhering to all applicable laws and regulations governing the collection and management of such Users-of-Users Information, including privacy and data protection laws in relevant jurisdictions.

You bear the responsibility for the security, integrity, and lawful use of Personal Information pertaining to Users-of-Users. This includes obtaining necessary consents, permissions, and providing any mandatory data subject rights and fair processing notices required for the collection and use of such Personal Information.

While ClickMe does not offer legal advice to Users or their Users-of-Users, we strongly recommend that all Users maintain clear and comprehensive privacy policies on their User Websites in accordance with applicable laws and regulations. Additionally, we advise Users-of-Users to carefully read and understand these policies and, to the extent required by applicable law, provide consent as necessary.

For more information on how ClickMe may handle Users-of-Users Personal Information (which may be relevant for any specific notice or consent you provide to your Users-of-Users), please refer to Sections 4, 12, and 13.

If you are a visitor, user, or customer of any of our Users, please note the following: ClickMe does not have a direct relationship with Users-of-Users whose Personal Information it processes. If you are a visitor, user, or customer of any of our Users and have inquiries or requests regarding your Personal Information, please contact the respective User(s) directly. For instance, if you wish to request access, correction, amendment, or deletion of inaccurate Personal Information processed by ClickMe on behalf of its Users, please address your request to the relevant User (who is the "Controller" of such data). If ClickMe is instructed by our Users to delete Users-of-Users' Personal Information, we will respond promptly to such requests following verification and in compliance with applicable law (e.g., within thirty (30) days under the GDPR). Unless otherwise directed by our User, we will retain Users-of-Users' Personal Information for the duration outlined in Section 12 below.

7. Use of cookies and other third-party technologies

We and our Third Party Service Providers use cookies and other similar technologies (“Cookies”) in  order for us to provide our Service and ensure that it performs properly, to analyze our performance and marketing activities, and to personalize your experience.

Please note that we do not change our practices in response to a “Do Not Track” signal in the HTTP header from a browser or mobile application, however, most browsers allow you to control cookies, including whether or not to accept them and how to remove them. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser.

8. Communications from ClickMe

8.1. Promotional messages

We may use your Personal Information to send you promotional content and messages by e-mail, text messages, notifications within our platform, marketing calls and similar forms of communication from ClickMe or our partners (acting on ClickMe's behalf) through such means.

If you do not wish to receive such promotional messages or calls, you may notify ClickMe at any time or follow the “unsubscribe” or STOP instructions contained in the promotional communications you receive.

8.2. Service and billing messages

ClickMe may also communicate important information about our Services or your utilization of them. For instance, we might notify you (via any available communication method) when a particular Service undergoes temporary suspension for maintenance, respond to your support inquiries or emails, send reminders or alerts regarding upcoming or overdue payments for your active or upcoming subscriptions, relay reports of abuse related to your User Website, or inform you of significant alterations in our Services.

It is crucial that you remain able to receive these messages. Consequently, you cannot opt-out of receiving such Service and Billing Messages unless you decide to discontinue your status as a ClickMe User, which can be accomplished by deactivating your account.

9. Your rights in relation to your ‘Personal Information’

At ClickMe, we firmly believe that all of our users should have control over their Personal Information. Depending on how you utilize the ClickMe Services, you may have various rights related to your Personal Information. These rights include the ability to request access to, receive a copy of, update, amend, delete, port to another service, restrict, or object to specific uses of your Personal Information (e.g., for direct marketing purposes). Furthermore, if we rely on your consent for processing your Personal Information (such as for direct marketing), you have the right to withdraw your consent at any time, with the withdrawal taking effect from that point onward.

We want to assure you that exercising any of these rights will not result in additional charges, and you will continue to receive the same level of service.

If you are a ClickMe user, you can access and rectify much of your Personal Information directly through your account or by using online forms provided by ClickMe (details provided below). Alternatively, you can exercise your rights by reaching out to us at support@clickme.club, sending a written request to our address at ClickMe, 1-4-180/22, Sai Baba Officer's Colony, Road No. - 3, 3rd Avenue, Sainikpuri, Hyderabad - 500094, Telangana, India, or by contacting our customer care department. For security and privacy reasons, we may need to verify your identity before fulfilling your request.

Please note that before acting on your request, we may request additional information to confirm your identity and for security purposes. We retain the right to impose a fee where permitted by law (e.g., for unfounded or excessive requests).

You also have the right to lodge a complaint with your local data protection supervisory authority, although we recommend reaching out to us first.

If you are a ClickMe User and wish to obtain a copy of, access, or request corrections to the Personal Information you have stored with us (whether yours or your Users-of-Users'), or if you want to request a list of Personal Information (if any) related to you that we have disclosed to third parties for direct marketing purposes, please follow the instructions outlined in our Help Center articles titled "Retrieving Your ClickMe Account Data" or "Permanently Deleting Your ClickMe Account." We will make reasonable efforts to promptly address your request (unless we require additional information from you to fulfill it), subject to legal and other permissible considerations.

It's important to note that permanently deleting your ClickMe account results in the complete erasure of all your Personal Information from ClickMe's databases. Following this process, you won't be able to use any of your ClickMe Services, your account and all its data will be permanently deleted, and ClickMe will be unable to restore your account or retrieve your data in the future. If you contact our support channels in the future, the system will not recognize your account, and support agents will not be able to locate the deleted account.

10. Additional Information for California residents

If you are a California resident using our Services, the California Consumer Privacy Act ("CCPA") grants you specific rights concerning the Personal Information that ClickMe collects about you. These rights include:

  1. Right to Access and Deletion: You have the right to request access to and deletion of your Personal Information collected by ClickMe. You can also request information about how we collect, use, and share your Personal Information.

  2. Right to Opt-Out: California residents have the right to opt-out of the sale of their Personal Information by a business.

  3. Right to Non-Discrimination: You will not be discriminated against for exercising any of your rights under the CCPA.

It's important to note the following regarding your rights under the CCPA:

  • ClickMe does NOT sell your Personal Information or your customers' (Users-of-Users) Personal Information to third parties, and we have not sold Personal Information in the twelve months preceding the effective date of this Privacy Policy.

  • ClickMe does not discriminate against any User for exercising their rights under the CCPA.

To exercise your CCPA rights, you can do so directly or through an authorized agent by signing in to your registered ClickMe account at clickme.club and following the provided instructions. Please be aware that to protect your account and Personal Information and safeguard your privacy rights, we may verify your deletion and access requests. This verification process may involve requesting additional information or documentation, such as account-related details, billing information used for purchasing paid Services, and identity verification documents if necessary. Any identification documentation requested will be used solely for verification purposes and will be deleted after processing your request.

Instructions for exercising your CCPA rights are as follows:

Right to Know: If you want to exercise your right to know or receive a copy of your Personal Information stored with us, please contact us.

Right to Deletion: If you want to exercise your right to request deletion of any of your Personal Information that you have stored with us, please contact us.

Once we receive and verify your request, we will delete your Personal Information from our records, unless an exception applies. We will make reasonable efforts to fulfill your request promptly and in accordance with applicable law.

Please note that permanently deleting your ClickMe account erases all your Personal Information from our databases. After this process, you can no longer use any of your ClickMe Services, your account and its data will be permanently removed, and we will be unable to restore your account or retrieve your data in the future. Additionally, if you contact our support channels later, the system will not recognize your account, and support agents will not be able to locate the deleted account.

If you are unable to access your ClickMe account or wish to exercise your CCPA rights through an authorized agent, you or your authorized agent (as applicable) can send a request to support@clickme.club or contact our customer care department, including by requesting a callback from a customer care expert. To process your request, we may ask for the verifying information mentioned above, which may vary depending on the specifics of your request. Authorized agents will also need to provide ClickMe with a copy of the consumer's signed authorization designating them as their agent.

These rights described under CCPA may also apply to residents of other U.S. states as per applicable laws and regulations.

If you have any inquiries or concerns regarding our collection, use, or disclosure of Personal Information, or if you suspect that we have not adhered to this Privacy Policy or relevant data protection regulations, please get in touch with us. We may keep your Personal Information (including your Users-of-Users' Personal Information) for the duration of your active User Account, as outlined in this Privacy Policy, or for as long as necessary to provide you with our Services.

Even if you deactivate your User Account or discontinue using specific Services, we may still retain your Personal Information when reasonably required to fulfill our legal obligations, address disputes involving our Users or their Users-of-Users, prevent fraud and misuse, enforce our agreements, or safeguard our legitimate interests.

The determination of the appropriate retention period for Personal Information takes into account factors such as the volume, type, and sensitivity of the data, the potential risks associated with unauthorized use or disclosure, the purposes for which we process it, and the relevant legal obligations.
